JUDGEMENT

(1.) There are four separate criminal misc. applications filed by the same applicant bearing Application under section 482 No. 30780 of 2017, Application under section 482 No. 30779 of 2017, Application under section 482 No. 30782 of 2017 and Application under section 482 No. 30781 of 2017, which involve similar controversy and have similar prayers relating to the proceedings of complaint cases under Chapter XV of Code of Criminal Procedure instituted against the applicant for the offences under
Income Tax Act, 1961 pending in the court of Special C.J.M., Meerut and hence, all the four criminal misc. applications are being taken up, heard and decided by this common order with consent of parties.
(2.) At the very outset, Sri G.S. Chaturvedi, learned Senior Advocate submitted that because of some inadvertence two different prayers, which are not very compatible, have been simultaneously made in these applications for which actually two different applications ought to have been brought before the Court at appropriate stage and, therefore, at this stage, he does not want to press the prayer with regard to the validity of summoning orders passed in respective complaint cases whereby the accused have been summoned to face trial and the same may be dismissed as not pressed with liberty to move appropriate application if occasion arises.
(3.) In this view of the matter, all the four applications are being dismissed with regard to the prayer challenging the order issuing summons against accused at this stage with liberty to file another application, if the applicant is so advised at some future stage provided if the law would permit such course to be adopted.;
