JUDGEMENT

(1.) Heard Gopal S. Chaturvedi, learned Senior Advocate assisted by Sri Prashant Vyas, learned Advocate learned counsel for applicant, Sri M.C. Chaturvedi, learned Senior Advocate assisted by Sri S.C. Dwivedi, learned Advocate appearing for the complainant and learned A.G.A. and perused the record.
(2.) This bail application has been preferred by the accused-applicant, Ranu Alias Ranvir Singh, who is involved in Case Crime No. 1269 of 2012, under Sections 307 and 149 I.P.C. P.S.- Nadigaon, District-Jalaun.
(3.) Learned counsel for the applicant in support of his prayer for bail submits that the applicant is innocent and he has been falsely implicated. He further submits that the applicant is said to have ambushed the complainant on 24th April, 2014 at 5.30 p.m. and fired a shot from double barrel gun on the chest of the complainant. The learned senior advocate submits that from the medical examination report it is reflected that only five pellets were recovered. There is no supplementary report to show that injury was grievous. He further submits that doctor has not opined injuries to be dangerous for life, thus his first submission is that the offence would not travel beyond section 324 IPC. His second argument is that the criminal cases shown against the applicant have been been explained in para 20 of the supporting affidavit and in most of th cases police has submitted final report. Only two cases; one under section 427 IPC and one under sections 147, 148, 149, 323, 506 IPC the applicant has to obtain bail. Thus he submits that applicant has not been previously convicted. Most of the cases were found false. He has been implicated in the present matter due to enmity. This is a complaint case. Applicant has roots in the society. He is not likely to abscond.;
