Devendra Kumar Upadhyaya, J. - (1.) Heard learned counsel for the petitioners and learned Standing Counsel appearing for the State-respondents.

The petitioners challenge the decision taken on 29.05.2017 by the State Level Committee rejecting the application made by the petitioners-institutions seeking affiliation to run D.El.Ed/B.T.C. course. The said decision has been communicated to the petitioners-institution by the Secretary of Examination Regulatory Authority vide letter dated 30.05.2017, which has been annexed as annexure no.1 to the writ petition.

It is not in dispute that the petitioners-institutions have been recognized by the National Council for Teacher Education and accordingly had submitted its application seeking affiliation with the appropriate authority in the State Government in terms of the Government Order dated 18.01.2010. The procedure prescribed for processing the application seeking affiliation submitted by the petitioners-institutions is that the institution concerned is required to make its application before the Principal, District Institute of Education and Training concerned, who is required to get the spot inspection conducted and submit its report along with the said application to the Secretary of Examination Regulatory Authority. The application, thus, along with the inspection report is scrutinized by the Secretary of Examination Regulatory Authority, U.P., Allahabad and thereafter the entire matter is sent for consideration by the State Level Committee constituted under the said Government Order dated 18.01.2010, which comprises of an officer, nominated by the Principal Secretary in the department of Basic Education, Government of U.P., who is its Chairman and Director, Basic Education, Director, State Council of Educational Research & Training and Secretary of Examination Regulatory Authority as members and Member Secretary. In terms of clause 3(12) and 3(13) of the said Government Order dated 18.01.2010, recommendation/opinion has to be made by the State Level Committee in respect of the application received from the institutions seeking affiliation for conducting B.T.C./D.El.Ed. course and on the said opinion expressed by the Committee, ultimately the State Government has to take final decision.;
