JUDGEMENT

- (1.) At the very outset it is made clear that the cases of Sri Gopal S. Chaturvedi, learned Senior Advocate are not being heard by one of us (Ramesh Sinha, J.) on account of association with the chamber of Mr. Gopal S. Chaturvedi when (Ramesh Sinha, J.) was at Bar.
(2.) When the present matter came as fresh before this Bench today, Sri Shishir Tandon, learned counsel for the petitioner stated that in the present matter Sri Gopal S. Chaturvedi is appearing on behalf of the petitioner. When it was brought to his notice about the petitions filed by co-accused persons of the present F.I.R. have already been dismissed by one of us (Ramesh Sinha, J.) then Sri Gopal S. Chaturvedi, learned Senior Advocate appeared on behalf of the petitioner and stated that he has some reservation in the matter.
(3.) Earlier also an instance came up before one of us (Ramesh Sinha, J.) while sitting singly in Crl. Misc. Writ Petition No. 14941 of 2014. In the said case, an application bearing Crl. Misc. Application No. 97068 of 2015 was moved on 24.3.2015 by the petitioner in the said case through his counsel before the then Hon'ble The Chief Justice for nomination of another Bench as the petitioner wanted to engage Sri Gopal S. Chaturvedi, learned Senior Advocate to argue the case on his behalf on which the then Hon'ble The Chief Justice has passed the following order:- "Application is rejected. Hon'ble Ramesh Sinha, J. has already been assigned the work in pursuance of the directions of the Supreme Court. If a particular Senior Counsel does not appear before the Court, he/she has to return the brief and not accept the case. A Bench which has been assigned by the Chief Justice has to hear the case and any attempt to avoid the Bench will not be countenanced at the behest any litigant.";
