JUDGEMENT

(1.) Heard Sri Krishna Kumar Seth learned counsel for petitioner and Sri Shailendra Kumar Seth learned counsel for opposite party.

By means of filing present petition under Article 226 of the Constitution of India, the petitioner has assailed the order dated 22.3.2017 passed by Additional Session Judge, Court No.2, Lucknow and order dated 19.5.2017 passed by Additional Chief Judicial Magistrate court No.28, Lucknow passed in complaint case No. 1888 of 2015 under section 12 of Domestic Violence Act, P.S. Vikas Ngar, Lucknow, Smt. Sarita Srivastava versus Pradeep Kumar Srivastava.

Brief facts giving rise to the present petition is that opposite party No.3 Sarita Srivastava filed a complaint case No. 1640 of 2013 under Section 12 of Protection of Women from Domestic Violence Act, 2005 with the prayer for claim of maintenance for herself and her three children and after proceeding with the case, the learned Chief Judicial Magistrate vide order dated 28.11.2015 allowed the application and directed the petitioner to pay an amount of Rs. 25,000/- to the complainant/respondent No.3 in this petition. Aggrieved by the order appeal No. 0000117 of 2016 was filed by Sarita Srivastava and Appeal No. 0000118 of 2016 was filed by petitioner before the court of session Judge which was transferred to the court of Additional Session judge, Court No.2, Lucknow and vide order dated 22.3.2017 appeal filed by petitioner was allowed and the order impugned was set aside with further direction to proceed with the case after giving an opportunity of hearing to the opposite parties. So far as payment of maintenance as directed by learned trial court below was concerned, the court vide order dated 22.3.2017 directed the petitioner to pay the amount regularly to the opposite party No.3. Aggrieved by the order, the present petition.;
