S.K.Singh, J. - (1.) Heard Sri R.N. Singh, learned Senior advocate assisted by Sri A.K. Rai, learned Counsel in support of this petition and Sri P.K. Sinha, learned advocate in opposition thereof.
(2.) Challenge in this petition are the orders passed by consolidation authorities which have been passed by them in a title proceeding. Although the matter is quite old and litigation is long drawn, but on the facts as will be shortly noticed, this Court has no option but for the reasons given to remit the matter to the Consolidation Officer for a full fledged trial after giving opportunity to both sides.
(3.) A brief notice of the relevant facts for dispersal of the matter will be in the fitness of things.;
