JUDGEMENT
S.N. Srivastava, J. -
(1.) Heard learned Standing Counsel.
(2.) The affidavit of compliance has been filed by the Standing Counsel and from a perusal of which it would transpire that the Committee constituted on the question of introduction of moral and physical education which includes fundamental duties has resolved to hold written examination for moral education carrying 50 marks and the remaining 50 marks will be ear-marked for practical examination to be held by the Head of Institution by way of awarding grade A, B and C. It is further enumerated in the resolution of the Committee headed by Director State Raj Vigyan Sansthan that there is no need for any separate subject with the avowed object of enlightening the students about AIDS as the same is included in various subjects such as Home Science, Biology, Chemistry etc. which subjects, if need be felt, can well be supplemented with further details in the aforesaid subjects. The decision commends to me for acceptance inasmuch as according to the view of the Court such education at a tender age is not going to sub-serve the purpose and rather it may prove counter productive and may have adverse impact on the students of such callow age i.e. students between the ages of 9 to 12 years.
(3.) Since directions issued by the Court have already been observed in compliance, nothing survives warranting any further action by the Court in the matter.;
