(1.) HEARD learned counsel for the parties.
This writ petition has been filed against the impugned order dated 8.9.1995 Annexure -8 to the writ petition. It is alleged in paragraph 2 of the writ petition that a short -term vacancy in L.T. Grade teacher arose in Janta Inter College, Marapar, Kusumhi Bazar, Gorakhpur on the ad -hoc promotion of an L.T. Grade teacher to the post of lecturer. It is alleged in paragraph 3 that the short term vacancy was intimated on the notice board of the college and was also advertised in daily news papers Hindi Dainik and Rastra Chinh Annexure -1 to the writ petition. The petitioner alleged that he was selected but he has not been paid salary.
As I have held in Surendra Kumar Dixit v. D.I.O.S. Agra and others, 1995 (26) ALR 501, even a short term vacancy has to be advertised in two well known newspapers having wide circulation. I have perused the cuttings of the newspapers Annexure -1 to the writ petition. These documents shows that the so called newspapers do not even look like a newspaper. There are several well known Hindi newspapers in the State having wide circulation e.g. Dainik Jagran, Aaj, Amar Ujala, Swatantra Bharat etc. and well known English newspapers like Times of India, The Pioneer etc. but it is deeply regretted that in almost all the cases which are coming in this court the vacancies are not advertised in well known newspapers having wide circulation, but are advertised in newspapers having little or no circulation and the result is that the best persons can not apply for the post. This court in the decision of Surendra Kumar Dixit (supra) has condemned this practice. The petitioner has failed to show that the newspapers Hindi Dainik and Dainik Rastra Chinh are well known newspapers having wide circulation in the State. Hence, the writ petition is dismissed. However, it is open to the Management Committee to advertise the post in two well known newspapers having wide circulation in the State. When it is advertised it is open to the petitioner to apply for the post along with others.;
