JUDGEMENT

K.J. Shetty C.J, R.M. Sahai, J. - (1.) The petitioner seeks admission to the post graduate course M.D. in Forensic Medicine on the ground that he is an internal candidate and his claim has been unreasonably overlooked by the respondent University.
(2.) The case of the respondent is that the petitioner cannot be treated as an internal candidate he having passed the MBBS examination more than three years earlier to the admission sought for. The only question, therefore, to be considered is whether the petitioner could be considered as an internal candidate. In this connection para 4 of the Guide of the University is quoted below : "An Internal candidate is one who has passed the qualifying examining from this University not earlier than 3 years from the date of admission to the course applied for, after undergoing a regular course of study for a period of at least one academic year in this University or its maintained Institutions."
(3.) The applications for admission were considered by the University in July, 1986. The petitioner passed his qualifying examination in February, 1983. The actual admission to the Post Graduate Course has taken place on 20th September, 1986. From these dates it will be clear that the petitioner has passed the qualifying examination more than three years from the date of admission to the course applied for. The contention of the petitioner, therefore, that he ought to be treated as an internal candidate does not merit any serious consideration.;
