JUDGEMENT

(1.) The petition seeks issuance of a writ in the nature of certiorari quashing First Information Report bearing Case Crime No. 340 of 2015, under Sections 419,420,467,468,471 Indian Penal Code, Police Station Ganga Ghat, District Unnao.
(2.) Order dated 29.5.2015 notices the gist of the issue raised by the petitioner. The order reads as under:-
"1. The petition seeks issuance of a writ in the nature of certiorari quashing First Information Report bearing Case Crime No. 340 of 2015 under Sections- 419, 420, 467, 468, 471 Indian Penal Code, Police Station Gangaghat, District Unnao.
2. Contention of learned counsel for the petitioner is that title of the petitioner has been recognized by the Civil Court and thereafter the appellate court as would be evident on perusal of Annexures 2 and 3. The said lis was between the petitioner and the complainant. Despite such facts, false allegations have been made in the First Information Report. There is no occasion to arrest the petitioner.
3. Considering the contents of Annexures 2 and 3 in context of the allegations made in the First Information Report, issue notice to respondent no. 3 to be served through Chief Judicial Magistrate, Unnao returnable on 3.8.2015.
4. List on 3.8.2015. Till the next date of listing arrest of the petitioner shall remain stayed.
4. In the meantime, it is directed that the petitioner shall cooperate in investigation and furnish the documents available with the petitioner so as to set up his case, with the investigating agency.
5. Let counter affidavit be filed. No further time would be given."
(3.) In the First Information Report filed by Akbal Bahadur son of Rajaram, the allegation is that, one Jagdish Narayan son of Radhe Shyam, has forged the Revenue records. The informant of the First Information Report has the bhumidhari rights and is in possession of the property mentioned in the report. However, when he inquired a month back from the revenue department, he found that Jagdish Narayan (petitioner) got his name entered in the Revenue records in place of the informer by forging the records.;
