JUDGEMENT

(1.) Heard Sri K.K. Arora, Advocate, for petitioners in Writ-C No. 28935 of 2000 and Writ-C No. 27261 of 2000, Sri Madan Bihari Lal, Advocate for petitioner in Writ-C No. 22319 of 2004. Sri Govind Krishna, Advocate for respondents no. 4 and 5 in Writ-C No. 28935 of 2000 and Sri Alok Kumar Srivastava, Advocate, holding brief of Sri S.S. Nigam appearing for respondent no. 6 in Writ-C No. 22319 of 2004. Sri M.K. Tripathi in person, for respondent no. 6 in Writ-C No. 28935 of 2000 and Sri Vijendra Rathor, Advocate holding brief of Sri N.P. Singh appearing for respondent no. 3 in Writ-C No. 28935 of 2000.
(2.) All the petitioners in these four writ petitions are Advocates, practicing in this Court. Sri A.D. Prabhakar, petitioner in Writ - C No. 28935 of 2000 and Writ - C No. 27261 of 2000 has been substituted by his legal heirs.
(3.) Dispute relates to Nazul land situated in 60 Civil Station, Civil Lines Allahabad. It is said that initially the disputed land was leased out to one Damodar Das for a period of fifty years on 27.02.1868 thereafter on 17.04.1920 a lease was executed in favour of Sohrabji Rustamji Gandhi for a period of fifty years w.e.f. 27.02.1918 and the said lease expired on 26.02.1968. It is also claimed that lease was transferred in favour of Sadiram Ganga Prasad of Kanpur, thereafter Sheikh Jahur Ahmad and his wife Smt. Madina Biwi on 29.03.1932 and then to Sri Beni Madhav Agrawal on 15.04.1943. In 1963-64 name of Beni Madhav Agrawal, the then Mayor, Allahabad was entered in the records of Nazul Department alongwith his two sons Narrotam Das Agrawal and Moti Lal Agrawal. On a part of land Sri Beni Prasad Agrawal during his tenure as Mayor, Allahabad constructed a huge building consisting ground floor and first floor and let out the same for commercial purpose after constructing several shops and lawyers chambers. The aforesaid building is across the road of this Court at Kanpur Road.;
