JUDGEMENT

- (1.) Re: Civil Misc. Delay Condonation Application
(2.) Heard learned counsel for the parties and perused the affidavit filed in support of this application. No counter affidavit has been filed. Cause shown for the delay in filing the appeal is sufficient. This application is allowed and the delay in filing the appeal is condoned. Re: Special Appeal
(3.) The present appeal has been filed by the appellant-petitioner challenging the order dated 30.3.3011 passed by the Writ Court in Civil Misc. Writ Petition No. 18097 of 2011 (Ansa Ram vs. State of U.P. and others) by which the said writ petition was dismissed. The operative portion of the said order is quoted as under:- "From the aforesaid facts and circumstances, it appears that the petitioner deliberately absented himself from duty and thereafter filed writ petition and obtained an order for decision of his claim for making payment of salary. In the absence of any material on record which may go to show that he has discharged his duty during the period, his claim for payment of salary for the said period has rightly been rejected by the District Inspector of Schools on the principles of 'no work no pay'. In view of the above, the impugned order does not call for interference. The writ petition accordingly fails and stands dismissed.";
