JUDGEMENT

- (1.) Petitioner has approached this Court challenging the order dated 25.7.2009 passed by the Sub Divisional Magistrate, Auraiya holding that the petitioner was not a resident of Distrct Auraiya prior to year 2000 and thus the domicile certificate issued to her was cancelled.
(2.) Facts, in brief, relevant for the purpose of the case are as under : Indian Oil Corporation Limited issued an advertisement on 24.8.2000 to appoint LPG Distributor for Nagar Panchayat Babarpur, district Auraiya. One of the qualifications prescribed in the advertisement was that the applicant must be a resident of district Auraiya. In pursuance of the advertisement, the petitioner also made an application. She was called for interview and her name was recommended by the Selection Committee at serial no. (1). Respondent no. 4 herein was also one of the applicant. She made a complaint to the District Magistrate, Etawah that the petitioner has obtained the domicile certificate by misrepresenting and concealing the facts and she was a resident of Kanpur Nagar. The District Magistrate, Etawah directed the Sub Divisional Magistrate, Auraiya to make inquiry into the matter. The Sub Divisional Magistrate, Auraiya vide order dated 11.2.2005 cancelled the domicile certificate issued to the petitioner. Aggrieved, the petitioner approached this Court by filing writ petition no. 12276 of 2005, which was disposed of vide order dated 15.5.2009 giving liberty to the petitioner to make a fresh representation before the Sub Divisional Magistrate, Auraiya, with a direction to him to pass fresh order.
(3.) In pursuance of the order dated 15.5.2009 of the Court, the petitioner made a representation before the Sub Divisional Magistrate, Auraiya dated 02.07.2009. The representation of the petitioner was dismissed by the Sub Divisional Magistrate vide order dated 25.7. 2009, which is impugned in this petition.;
