JUDGEMENT

(1.) Heard Shri Rajjan Singh and Shri R.K. Rathore, learned counsel for the petitioners and Shri R.K. Jaiswal and Shri S.K. Yadav for the respondents.

In these writ petitions, the petitioners have challenged the advertisement dated 14.11.2012 published in employment newspaper "Rojgar Prakash" for recruitment of Constable (Tradesmen and Technician) in Central Reserve Police Force, so far as it relates to declaring shortfall vacancies of 19 posts of Constable (Driver), arising out of the earlier recruitment held in the year 2011. They have further prayed for direction commanding the respondents to consider their case for appointment as they were duly selected in all examinations and tests held for recruitment in the year 2011 for the post of Constable (Driver/Cook) in C.R.P.F. by passing a reasoned and speaking order.

As per record, this much is reflected that an advertisement was published on 30.11.2011 for filling up 442 vacancies of Constable (Tradesmen and Technician) including 106 posts of Constable (Cook) in Central Reserve Police Force, Uttar Pradesh, Uttrakhand and in the said advertisement in question the age limit was prescribed between 18 to 23 years as on 1.8.2011 with requisite age relaxation to the reserved categories. All the petitioners belong to Other Backward Category. Consequently, they had proceeded to apply in pursuance of the aforesaid advertisement for consideration of their candidatures for recruitment on the post of Constable (Driver/Cook). They had appeared in the physical and fitness test in which they were declared successful for appearing in the written examination. On 12.2.2012 they had appeared in the written test held at CRPF Group Centre, Post Bijnor, District Lucknow and were declared qualified in the written examination. Thereafter vide letters dated 15.3.2012, 16.3.2012 and 17.3.2012 the petitioners were required to put their appearance for medical test and trade test before the Recruitment Board No.1 on 13.4.2012 and 18.4.2012. On the said date, they appeared for the medical test and trade test before the aforesaid Recruitment Board No.1 and they were declared fit in the medical test. The result of successful candidates in written test was declared in which names of the petitioners were found place. The petitioners were declared successful in physical test, written test as well as medical and trade test in the recruitment of Constable (Tradesmen and Technician) in CRPF, UP, Uttrakhand for 106 posts of Constable/Driver and 78 posts of Constable/Cook but no appointment letter was issued in their favours from the office of respondent no.2.;
