- (1.) Smt. Geeta Upadhyay is before this Court assailing the order dated 18.07.2012 passed by the Bal Vikas Pariyojana Adhikari, Dohrighat, District Mau, whereby the petitioner has been removed from the post of Mini Anganwadi Karyakatri on account of being the petitioner's correct date of birth as 13.10.1986, she does not come in the merit list of Mini Anganwadi Karyaktri.

As per record, this much is reflected that by means of an advertisement published in the newspaper dated 14.09.2010 the Zila Karyakram Adhikari, District Mau invited the application for the posts of Anganwadi Karyaktri and Mini Anganwadi Karyakatri/Sahayika for different Bal Vikas Pariyojana of District Mau. The posts were liable to be filled up on the contract basis with fixed honorarium and the appointments were to be made after selection by the Appointing Authority. So far as, the Bal Vikas Pariyojana of Dohrighat, District Mau, is concerned, 7 posts were reserved for S.C. & S.T., 8 posts were reserved for O.B.C. and 15 posts were reserved for general category. The requisite educational qualification for the post was High School but while fixing the merit, education upto Intermediate standard could be taken into account. The age limit was minimum 21 years on 01.07.2010 and the maximum age limit was 45 years. The petitioner has proceeded to apply for the post of Mini Anganwadi Karyakatri and she had proceeded to fill up the application form wherein she mentioned her date of birth as 13.10.1986 and, accordingly, on 01.07.2010 her age was 23 years 9 months and 28 days. The petitioner's educational qualification is High School and Intermediate and as such, the petitioner was fully eligible for the said post. Along with the application form she had also appended her High School Certificate for the year 2004. In the mark-sheet the Serial Number of the petitioner was mentioned as 8875300 and her date of birth was 13.10.1986. Consequently, the petitioner selected and appointed on the post of Mini Anganwadi Karyakatri. Consequently, the appointment letter was issued in her favour on 31.03.2011 by the Bal Vikas Pariyojana Adhikari, Dohrighat, District Mau. The petitioner joined her duty immediately as Mini Anganwadi Karyakatri.
(3.) Thereafter, she had also gone one month training session w.e.f. 05.08.2011 to 05.09.2011 and after completing her training she again joined her duty.;
