JUDGEMENT

(1.) Heard learned Counsel for the parties.
(2.) This writ petition is directed against the order dated 9.12.1982 passed by Deputy Director of Consolidation, Ghaziabad in Revision No. 234 Ombir v. Adimal Singh and Raj Karan Singh. Revision has been allowed on the ground that the position of both, the revisionist (Ombir Singh, respondent No. 2 herein) and opposite parties (petitioners herein) was exactly equal and both were feeling difficulty in having their land adjacent to the land of the relations of the other party and both might face the irrigation difficulties.
(3.) Revision under section 48 of U.P. Consolidation of Holdings Act cannot be allowed on such flimsy grounds. There is no provision under the Act to the effect that a person must be allotted chak near the chak of his relations. In any case, petitioners did not demand that their chak should be reallocated or re-adjusted. The order is rather whimsical. Revision or appeal even on facts can be allowed only when some fault is found in the order challenged therein.;
