JUDGEMENT
Krishna Murari, J. -
(1.) Heard Sri P.K. Misra, learned Counsel for the petitioners and Sri P.S. Sharma, appearing for contesting respondents No. 2 to 7.
(2.) This petition arises out of chak allotment proceedings. Shorn of unnecessary detail, facts relevant for the purposes of the case are as under:
Writ Petition No. 2806 of 1994 filed by contesting respondents was disposed of by this Court vide order dated 17.11.2000. The order passed by this Court is quoted hereunder:
"Hon'ble R.P. Misra, J.
Heard Sri A.B. Singh, learned Counsel for the petitioners and Sri A.P. Tewari, learned Counsel for the contesting respondents. With the consent of the learned Counsel for the parties, this writ petition is being decided at the admission stage.
The grievance of the petitioners is that they have got boring in one of their plots but the same has not been allotted to them. Nothing has been said by the Deputy Director of Consolidation whether the boring claimed by the petitioners is in their plot or not rather it has been stated that the boring is near the Chak of Ramdhir. Considering the facts and circumstances of the case, the order dated. 15.12.1993 passed by the Deputy Director of Consolidation is quashed and Deputy Director of Consolidation is directed to decide the matter afresh specifically recording a finding whether the boring claimed by the petitioners is in their plot. If that be so, the same may be allotted to the petitioners."
(3.) After remand made by this Court, Deputy Director of Consolidation re-heard the matter and vide order dated 6.11.2003 allowed the revision and disturbed the chak of the petitioners.;
