K.N. Singh, J. - (1.) The petitioner's grievance is that his result for B. Ed. Examination to which he appeared in 1982 as a regular student of Ratan Singh Degree College, Bansi, district Basti is not being declared by the University of Gorakhpur. Aggrieved, the petitioner has approached this Court by means of this petition.

In the counter-affidavit filed on behalf of the University, it is asserted that the Committee which was constituted under Section 28(5) of the State Universities Act for selection of students for admission to B. Ed., Course did not select the petitioner. The committee selected 26 candidates for admission to B. Ed. Course in the Ratan Sen Degree College, Bansi. The petitioner's name was not included in that list, yet the Principal of the College in collusion with the petitioner inserted the name and admitted him. When the University came to know of this fact, it refused to accept the petitioner as a validly admitted candidate. It has, therefore, decided not to declare the petitioner's result.
(3.) Having regard to the aforesaid facts and circumstances we do not think it a fit case for interference, as any interference by us will encourage similar activities which is a growing mala fide these days. Petition dismissed.;
