JUDGEMENT

(1.) The petitioner has prayed that the letter dated 1.4.2015 along with the remarks thereon dated 8.4.2015 be set aside and the respondents be restrained from interfering in the matter of the petitioner in pursuing the Special B.T.C. Training-2007 under the Male/Physically Handicapped (Locomotor Disability) category.
(2.) Briefly stated the facts of the case are that in pursuance of an Advertisement published in the newspaper 'Dainik Jagran' on 17.7.2007 the petitioner applied for Special B.T.C. Training, 2007. There was a reservation quota for physically handicapped persons. The petitioner is stated to be a handicapped person with 60% locomotor disability as per the certificate of the Chief Medical Officer, Ghazipur. The petitioner is also stated to be High School, Intermediate and B.A. pass and has also done his teacher training degree in Bachelor of Education from the Indira Gandhi National Open University, New Delhi.

It is further stated that the Teacher Training Degree of Bachelor of Education from the Indira Gandhi National Open University, New Delhi was not accepted by the respondents as the requisite Training Certificate and therefore other candidates approached the High Court by filing Writ Petition which was dismissed but the Special Appeal No.1271 of 2007, Gyanendra Kumar Sharma and 49 others vs. State of U.P. and others was allowed vide judgment dated 3.10.2007. It is further stated that S.L.P. filed by the State Government against the aforesaid judgment dated 3.10.2007 was also dismissed by the Supreme Court vide judgment dated 18.11.2014. Thereafter notification dated 7.2.2015 was issued requiring the candidates to appear before the Director State Council of Education Research and Training on 12.2.2015 along with the original testimonial. The petitioner also participated in the process of counseling and his testimonials being found to be genuine, his name was included in the final select list for Special B.T.C. Training 2007 and he was permitted to undergo training w.e.f. 2.3.2015.;
