JUDGEMENT

(1.) Heard Shri R.K. Ojha, Senior Advocate assisted by Shri Gautam Baghel, learned counsel for the petitioners and Shri H.C. Pathak, learned Standing Counsel for the State respondents. Shri Sandeep Saxena appears for private respondent no.4.
(2.) In these writ petitions the petitioners have prayed for quashing the orders dated 19.12.2013 (despatched on 2.1.2014), 3.1.2014 and 22.7.2014. They have further prayed for direction to the respondent authorities to treat their services deemed to have been approved as per Statute 21.03 (4) of the First Statute of Kanpur University w.e.f. 25.12.2013 and to pay regular salary to them w.e.f. 25.12.2013.

Brief facts giving rise to the writ petitions are that Bhavan's Mehta Mahavidyalaya, Bharwari, Kaushambi ( hereinafter referred to the institution) is run and managed by Bharatiya Vidya Bhawan Mumbai. The institution is affiliated to Chhatrapati Shahu Ji Maharaj University, Kanpur and is receiving grant-in-aid from the State Government. The service conditions of Class-III and Class-IV employees of the Degree Colleges affiliated to C.S.J.M. University, Kanpur are governed by Chapter-XXI Statute 21 of the First Statute of Kanpur University. In the said institution, two substantive vacancies for the posts of Stenographer and Office Clerk occurred due to superannuation of Sri Jagdish Chandra Pant and Smt. Tara Devi Mishra on 30.9.2010 and 30.4.2011 respectively. The Director of Higher Education, Allahabad granted permission (Anugya) to the institution for filling the aforesaid vacancies on 12.11.2010 and 12.7.2011. After taking permission from the Director of Higher Education, the Committee of Management advertised these two vacancies in two widely circulated Hindi newspapers "Aaj" and "Amrit Prabhat" on 3.9.2011. In pursuance of the advertisement dated 3.9.2011, 8 applications were received for the post of Stenographer and 17 applications for the post of Office Clerk.;
