- (1.) Petitioner before this Court seeks quashing of the results dated 15.8.2015 published by State Mental Health Authority/Nodel Officer (DMHP) and head of the Department Geriatric King Georg Medical University, Lucknow, for the post of clinical psychologist.
(2.) According to the petitioner, under the advertisement dated 28.4.2015 two posts were advertised under heading 2 i.e. (a) clinical psychologist and (b) psychologist. Total number of posts advertised was 10 within different reserved categories. It is stated that after the selection, all the posts have been filled by clinical psychologist. The petitioner, therefore, submits that respondents have committed error in not filling any of the post advertised for appointment against the post of psychologist.

This Court in order to ascertain as to what are the requirements for appointment on the post of psychologist under the District Mental Health Programme has gone through the policy group/guidelines enclosed at page 53 to the present petition. In column 'C' of the said policy guidelines, it is observed that appointment on the post of clinical psychologists has been provided alongwith the qualifications, which are (i) Ph.D. in Clinical Psychology from a recognized university and (ii) M.Phil in Clinical Psychology from a recognized university and a Masters decree in Clinical Psychology/Counselling Psychology/Psychosocial Counselling/Psychosocial Rehabilitation from a recognized university. It is only when a clinical psychologist is not available that as an interim measure, psychologist with BA in psychology and appropriate clinical experience may be appointed. It is admitted on record that the petitioner does not have the requisite qualifications for the post of clinical psychologist. He is neither Ph.D. nor M.Phil, nor he has a masters decree in in clinical psychology etc. It is not in dispute that requisite numbers of clinical psychologists have been selected in terms of the advertisement as against the required strength. Since the department had been able to find sufficient numbers of clinical psychologists, it is justified in not appointing a person against the post of psychologist.;
