- (1.) Heard Sri S.K. Mishra, learned Counsel for the appellants, and Sri Shivam Yadav, learned Counsel for the respondent-authority, and learned Standing Counsel.
(2.) This first appeal is directed against the judgment and order dated 26th May 1999 passed by the XIth Additional District Judge, Ghaziabad in Land Acquisition Reference No. 11 of 1999 (Nathu vs. State of U.P. and others), under Section 18 of the Land Acquisition Act, 1894 (for short, the "Act").

In the present case, the notification under Section 4 of the Act was issued on 23rd July, 1991 for acquisition of the land situated in Village Yaqubpur, Tehsil Dadri, District Ghaziabad for New Okhla Industrial Development Authority (NOIDA), followed by declaration under Section 6 of the Act, possession was taken on 30th March, 1992. The Special Land Acquisition Officer by an award dated 13th November 1995 in respect of the entire acquired land offered compensation at the rate of Rs. 63.26 paise per square yard. On reference, the XIst Additional District Judge, Ghaziabad vide impugned judgement and order dated 26th May, 1999 enhanced the rate of compensation to Rs. 105.71 per square yard. Dissatisfied with the order of the Court of Reference, this appeal has been filed.;
