Akhtar Husain Khan, J. - (1.) Present petition has been moved by petitioner, Bhartendu Pratap Singh, under Sec. 482 of Criminal Procedure Code with prayer to quash order dated 30.9.2015 passed by Special Judge, SC/ST Act/Additional Sessions Judge, Lucknow in revision No. 267/2015 filed against order dated 3.7.2015 passed by Judicial Magistrate -III, Lucknow in Criminal Case No. 13126/2010, "State versus Bhartendu Pratap Singh and others" along with said order dated 3.7.2015 passed by Judicial Magistrate -III, Lucknow in above case. Further prayer has been made to direct court below to issue process against offenders named in application moved under Sec. 190(1)(b) of Cr.P.C.
(2.) I have heard Shri Dilip Kumar, learned counsel for petitioner as well as Shri Salil Kr. Srivastava, learned counsel for opposite party No. 2, complainant and learned A.G.A., Shri Rajesh Kumar Singh for opposite party No. 1, State of U.P.

It is contended by learned counsel for petitioner that impugned order dated 3.7.2015 passed by Judicial Magistrate -III as well as impugned judgment and order dated 30.9.2015 passed by Special Judge, SC/ST Act/Additional Sessions Judge, Lucknow in revision are factually incorrect and contrary to record as well as perverse and inconsistent with law. It is further contended by learned counsel for petitioner that evidence and material collected in further investigation are sufficient to summon persons named in application moved by petitioner under Sec. 190(1)(b) of Criminal Procedure Code for offences mentioned in it.;
