JUDGEMENT
Bharat Bhushan, J. -
(1.) Supplementary affidavit filed by learned counsel for the applicant today is taken on record.
(2.) Learned AGA has accepted notice on behalf of respondent no. 1 State. Heard Sri J.B.Singh, learned counsel for the applicnat and learned AGA for the State.
(3.) It appears that Smt. Madhu Goyanka, respondent no. 2, filed a complaint under section 138 of Negotiation Instruments Act (in short, N.I.Act) against the applicant alleging that five cheques of Rs. Five Lacs each were issued by the applicant in discharge of his liability. Thereafter, the payment of these cheques were stopped and cheques were not honoured. A notice was given to the applicant on 2.3.2013 for payment of cheques' amount within 15 days. The notice is said to have been served upon the applicant and yet the payment was not made. Thereafter, a Criminal Complaint under section 138 of N.I. Act bearing No. 4602 of 2014 was filed against the applicant. The trial court obtained evidence under sections 200 and 202 Cr.P.C. along with documentary evidence and thereafter, summoned the applicant under section 138 N.I.Act vide order dated 3.12.2014.;
