JUDGEMENT
-
(1.) THESE two writ petitions are based on identical set of facts raising common question of law, hence, have been clubbed and heard together and are being disposed of by this common judgment.
(2.) HEARD Shri Shachindra Mishra, learned counsel for the petitioner, learned Standing Counsel for the State respondents and Shri K.R. Sirohi, learned Senior Counsel assisted by Shri Bal Krishna appearing for respondent no. 4.
(3.) PETITIONER has approached this Court seeking the following reliefs.
"I. Issue an appropriate writ, order or direction in the nature of certiorari to quash the notice under Section 11 (1) issued by respondent no. 3/Award dt. 12.11.2014 made by respondent.
II. Issue an appropriate writ, order or direction in the nature of mandamus commanding the respondents to proceed the acquisition proceeding in pursuance of the petitioners according the provisions of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
III. Issue an appropriate writ, order or direction in the nature of mandamus commanding the respondents to make the compensation as four times of the market value of the land.
IV. Issue any other or further writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
V. Award the costs of the petition to the petitioner.
The aforesaid reliefs have been claimed in the background of the following facts."
The land belonging to the petitioner was subject matter of acquisition. Notification under Section 4 (1) of the Land Acquisition Act, 1894 (for short Act) was published in the newspaper on 23.11.2011. Objections were invited under Section 5A of the Act. After report submitted by the Collector, State Government issued declaration under Section 6 of the Act dated 22nd November, 2012, which was also published in two daily newspapers on 8th December, 2012. Notice under Section 9 (1) of the Act was issued on 04.01.2013 fixing 10th January, 2013 and 19th January, 2013 for hearing.
It is alleged that the petitioner never received any compensation and, thus, is entitled for payment of compensation in accordance with Section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. ;
