JUDGEMENT
S.U. Khan, J. -
(1.) Due to persistent efforts of learned Counsel for both the parties, on the suggestion of the Court, both the parties have arrived at specific compromise. Earlier the Court had indicated the view that the case deserved to be decided on the basis of compromise. The Court places on record great appreciation for Counsel for both the parties Sri B.N. Agarwal, learned Counsel for the landlord and Sri M.A. Qadeer learned Counsel for the tenant in this regard. Accordingly judgment and order dated 24th November, 2003 passed in the writ petition is set aside, review petition as well as writ petition are disposed of in terms of the compromise. The compromise which has been filed through application of date signed by learned Counsel of both the parties supported by the affidavit of one of the landlords, petitioners and the tenant shall form part of this order.
(2.) However, if any difficulty arises in the working of the compromise then any party is at liberty to file application for suitable direction or clarification in this very petition. Though compromise new construction is to be made after demolition of the existing one. Tenant has agreed to have over possession of the entire accommodation to the landlord within six months. Landlord shall submit the map for new construction within one month after showing the same to the tenant. The local body which has to pass the map is strictly directed either to pass the map or point out its objections within two months fro the date on which map is submitted for approval before it. No laxity in this regard on the part of the local body which is competent to pass the map will be appreciated.
(3.) Review petition and writ petition accordingly disposed of in terms of compromise.;
