S.K. Singh, J. - (1.) Challenge in this petition is the order by which entry of Assami in favour of petitioner on the basis of Assami lease has been directed to be expunged and the land has been directed to be recorded in the name of Gaon Sabha.
(2.) Learned Counsel for the petitioner learned Standing Counsel and Sri Anuj Kumar who appears for the Gaon Sabha have been heard.
(3.) At the very outset learned Counsel for the petitioner submits that in the similar set of facts large number of writ petitions filed before' this Court were allowed and matter has been remanded back to the concerned Court to take fresh decision after giving opportunity of evidence and hearing to the parties. Submission is that admittedly impugned order is without any notice and opportunity to the petitioner and thus that is in violation of Principle of Natual Justice.;
