JUDGEMENT
S.N.Srivastava, J. -
(1.) When the matter was taken up on 14th March, 2005 this Court after recording argument of the learned Counsel for the petitioner, on the request by the learned Counsel for the respondents permitted to obtain instructions so as to enable this Court to finally dispose of the matter with the agreement of the parties.
(2.) Pursuant to the undertaking given by the learned Counsel for the petitioner appearance has also been filed by respondent No. 5 and now B.K. Narayan, learned Advocate has appeared for respondent No. 4 and thus all the parties learned Counsel stated before this Court that it will be n the ends of justice to dispose of the matter by giving direction to the Revisional Court to decide the matter finally either way as filing of counter-affidavit and then deciding the matter may delay disposal of the case and that may not be in ends of justice.
(3.) In view of the aforesaid as agreed by the learned Counsel for the parties, matter is being heard and finally derided.;
