JUDGEMENT

(1.) Challenge in this petition is the judgment of the Deputy Director of Consolidation dated 22.11.2001 by which the revision of the opposite party has been partly allowed.
(2.) Proceedings are under section 20 of the U.P.C.H. Act which is in respect to the adjustment of the chaks. As the pleadings are complete, as requested by the learned Counsel matter is being finally decided.
(3.) After hearing learned Counsel for the parties the following facts and situation emerges. There is no dispute about the fact that objection under section 9 of the U.P. C.H. Act filed by the opposite party in respect to enhancement of the valuation of plot No. 411/2 was rejected by the order of the Consolidation Officer dated 16.8.2001 (Annexure No. 5 to the writ petition) which is said to have become final. It appears that objection also proceeded under section 20 of the U.P. C.H. Act which was decided by the Consolidation Officer against which appeal was filed by the respondent in the appeal in para 4 it was stated that land was affected by shadow and, therefore, it has been valued at 30 paise. Appellate authority on a consideration of the appeal dismissed the same. Revision filed by the respondent has been allowed and the value of the land in dispute has been enhanced from 30 paise to 90 paise.;
