JUDGEMENT

(1.) At the request of learned counsel for the parties the matter is disposed of finally as the points which has been raised in all the applications are fully covered under the decision of this court, the copy of which has been filed alongwith the writ petitions. In all these writ petitions the common questions of fact and law involve and as such the same are being disposed of by this common judgment.
(2.) The petitioners have been appointed on daily wages as a Class IV in Forest Department at Jhansi Their appointments are of the dates May, 1984, 1st of July, 1981, July, 1981, November, 1983, July, 1981, July, 1884 July, 1986 and July 1980 The petitioners in the writ petitions prayed for issuance of writ of mandamus against the respondents counting then to regularise their services in Class IV cadre and to pay them regular pay scale i.e. 750-940.
(3.) Learned counsel for the petitioners has argued that even after completing more than 10 years services almost all by petitioners except one who is completed 8 years services but still the department is counting them on daily wages. The are being paid Rs. 23/- per day or consolidated salary of 690/-per month The action of the respondents to continue the petitioners for years together on consolidated salary is highly arbitrary, unjustified and violative of Articles 14, 21 and 39 of the Constitution of India.;
