PRESENT appeal has been filed by the defendant -appellant, challenging the judgment and decree dated 24.04.2012 passed by Additional District and Sessions Judge, Court No. XII, Moradabad in Civil Appeal No. 101 of 2011. Factual controversy involved in the presnt case are that M/S Hindustan Petroleum Corporation Limited is a Government of India Enterpirses having its registered office at 17 Jamshedji Tata Raod, Mumbai is engaged in refining, marketing and selling of motor spirit, high speed diesel, petroleum products etc.;
