JUDGEMENT

- (1.) HEARD Sri R.K. Ojha, senior counsel assisted by Sri Akhilesh Kumar Singh for the appellant and Sri S.K. Rai, appearing for the respondents. Perused the record.
(2.) THE present special appeal challenges the judgment and order dated 29.10.2013 passed in Civil Misc. Writ Petition No. 59679 of 2013, Smt. Shashi Singh Vs. Union of India and others. The order is short one and for appreciation of the facts is reproduced herein under : "1. Learned counsel for petitioner, after some argument, stated that petitioner is ready to re -appear for typing test, for which information was earlier given on 27.7.2013. In this regard, respondents may be directed to communicate the date on which the said test will be conducted and undertook that the petitioner shall appear in the said test. 2. Sri R.B. Singhal, learned Senior Advocate, appearing for respondents, stated that within a fortnight from today, petitioner shall be communicated specific date to appear in fresh typing test. 3. In view of above statement, in my view, no further order is required to be passed. 4. The writ petition is disposed of."
(3.) THE letter dated 27.7.2013 referred in the impugned judgment issued by Deputy Inspector General, C.R.P.F. Group Centre, Allahabad, states that pursuant to the letter dated 22.7.2013 typing test on computer software would not be taken between 31.7.2013 to 1.8.2013. The letter dated 27.7. 2013 is quoted below: XXX XXX XXX Brief facts giving rise to this appeal are that husband of the petitioner -appellant late Amit Singh - a constable/driver in C.R.P.F., died on 25.7.2007 in harness, leaving behind appellant -Smt. Shashi Singh as his legal heir and representative. She being dependant and qualified for appointment on the post of Hawaldar (ministerial) in C.R.P.F., was offered appointment on the aforesaid post on compassionate grounds subject to requisite test and interview. Pursuant to the call letter issued, she appeared in the test and qualified in the written examination. Case of the appellant is that typing test was not required for appointment under Dying in Harness Rules and therefore she did not appear and was declared failed in the typing test for post of Hawaldar (ministerial) in C.R.P.F.;
