JUDGEMENT

- (1.) HEARD Mr. Asit Kumar Chaturvedi, learned counsel for the petitioner as well as learned Standing Counsel.
(2.) THE petitioner has assailed the order dated 28.11.2012 (Annexure No. -1) passed by the District Magistrate, Sultanpur, whereby the petitioner's case for regularization has been rejected. The ground for rejection is that in the seniority list prepared on 05.05.2008, the petitioner has been placed at serial no. 131 and no junior to the petitioner has been regularized. More so the seniority list is also disputed before this Court. It is also stated that only four posts for regularization to the post of Seasonal Collection Amin are available but since there is ban on regularization of Seasonal Collection Amin, imposed by the Government Order dated 24.09.25012, therefore, the petitioner's case cannot be considered.

LEARNED counsel for the petitioner drew attention of this Court towards the select list brought on record by the respondents (Annexure No. CA -2) which is the seniority list of scheduled caste category. In this list, the petitioner is placed at serial no. 3. Through the supplementary affidavit the petitioner has also brought on record, the Government order dated 26.02.2014, whereby the State Government has lifted the ban on appointment of Collection Amin from amongst the Seasonal Collection Amin under 35% quota. He further submits that though the respondents have taken the ground of ban on appointments but during this period, they have made appointment of several persons whose names have been indicated by the petitioner in paragraph -3 of the rejoinder affidavit. Thus, it is stated that all the grounds taken for rejection of the petitioner's case are over, therefore, the petitioner is entitled to be considered for regular appointment for the post of Collection Amin.;
