JUDGEMENT

- (1.) THE petitioners have filed the present writ petition seeking following reliefs: - "(I) A writ, order or direction in the nature of certiorari quashing the Counseling dated 16 and 17.6.2014 of B.Ed. Training Course 2014 -15 for group Arts and Commerce which took place at venue of respondent no.3 and direct to the respondents to re -fix a new dates for re -counseling for B.Ed. Training Course 2014 -15 for group Arts and Commerce of the candidates/petitioners having merits to be admitted for the seats of B.Ed. Training Course 2014 -15 of group Art and Commerce available in Government aided colleges in State of U.P. (II) A writ, order or direction in the nature of mandamus commanding and directing to the respondents to allot/adjust the seats for admission to the petitioners for B.Ed. Training Course 2014 -15 for group Arts and Commerce in any aided Government College running in the State."
(2.) BUNDELKHAND University was assigned the responsibility for conducting B.Ed. entrance examination for the academic session 2014 -15. Pursuant to the advertisement issued by the University, petitioners claim to have applied for admission to B.Ed. Training Course. While petitioner no.1 belongs to general category, the petitioner no.2 is from OBC category. It is not in dispute that both the petitioners cleared the entrance examination with petitioner no.1 securing 3309 rank, while petitioner no.2 got 8914 rank. Thereafter, both the petitioners appeared for counseling.
(3.) THE brochure has been produced, according to which, the counseling was begin from 16.6.2014 and depending upon the rank of the students, different stages were specified. Candidates having rank of 1 -12000 were placed in Stage - 1, for whom document verification and fee submissions at counseling centre was to take place on 16th and 17.6.2014. The brochure also provided that applicant could indicate their preference for different colleges within a period of 2 - 3 days from their own residence or where over facility of internet is available. The grievance of the petitioner no.1 is that he intended to obtain admission to an aided college, for which he had indicated his preference but the same was denied to him, even though persons with lower merit have been given admission in the aided college. The petitioner submitted a representation on 21.6.2014 stating that the server of the internet was down and that he could only indicate his choice for locking 15 colleges and that he be allotted admission in any other aided college throughout the state.;
