VERSUS
D D C And 5 Ors Respondents

JUDGEMENT

- (1.) HEARD Sri P.C. Mishra, learned counsel for the petitioner and learned standing counsel for the State -Respondents.
(2.) THIS writ petition is directed against the order dated 25.6.2014 passed by the Deputy Director of Consolidation, Jaunpur (the DDC), whereby he has allowed a restoration application filed by the contesting respondents after condoning the delay. The order dated 18.3.1998 has been set aside and the revision has been restored to its original number.
(3.) THIS writ petition arises out of proceedings for allotment of chaks. It appears that four revisions were decided by a common orders. The petitioner thereafter filed a restoration application which was rejected by the DDC. This order was challenged by means of WP No. 1200 of 1987. This writ petition was allowed. The orders, both on the restoration application as also the order on merits were set aside and revision No. 296 was remitted back for fresh consideration in accordance with law. It is the case of the petitioner that since Raj Bahadur, the father of the contesting respondent, was dead, a substitution application was filed in that regard. The DDC issued notice on the substitution application. Subsequently, the substitution applications were allowed. Since no one appeared despite notice, the revisions were decided ex parte on 18.3.1998.;
