JUDGEMENT

- (1.) THE present writ petition has been filed by the petitioner, inter -alia, praying for following reliefs: (A) A writ, order or direction in the nature of certiorari quashing the order dated 3.5.2001 passed by the respondent no.3 (ANNEXUE No. 16). (B) A writ, order or direction in the nature of Mandamus to direct the respondent no.3 to issue an appointment letter on the post of Lekhpal to the petitioner. (C) Issue any other order or direction to deem fit and proper under the circumstances of the case. (D) To award cost of this petition in favour of the petitioner.
(2.) THE brief facts which give rise to this writ petition are that: In the year 1989, an advertisement inviting applications for the post of Lekhpal was issued by the respondent no.3 for which the petitioner was fully qualified for the same by duly submitting application form. Initially an advertisement was issued for filling -up 89 posts of Lekhpal in District Fatehpur among which 3 present posts of Lekhpal was reserved for the candidate dependent on freedom fighters. The grandfather of the petitioner actively took part in freedom movement and the petitioner was entitled in the reservation as dependent of freedom fighter. After scrutiny the application form of the petitioner, the petitioner appeared in written examination and after declared successful, he was appeared in physical test as well as interview.

IN spite of being successful in the written examination and interview, the petitioner was not selected and upon inquiry, the petitioner was told that only one post for dependent of freedom fighter has been filled -up. Thereafter, the petitioner moved several applications and representations before the authority concerned. Thereafter, petitioner approached the higher authorities, Minister of Revenue U.P. Government but nothing was done and his representations remained undisclosed. When the representations and applications remained undisclosed, he has left no option but to file writ petition.;
