THE writ petition has been filed for quashing the order of Regional Inspectress of Girls School (respondent -1), (hereinafter referred to as RIGS) dated 07.11.1988, approving the appointment of Bramha Kumar Saxena (respondent -3) on the post of clerk in Sukhdei Balika Uchchatar Madhyamik Vidyalaya Mandir, Maheba, Etawah and for mandamus directing respondents -1 and 2 to promote the petitioner on the aforesaid post as directed by letter of RIGS dated 21.10.1988.
(3.) SUKHDEI Balika Uchchatar Madhyamik Vidyalaya Mandir, Maheba, Etawah is recognized under U.P. Intermediate Education Act, 1921 up to Intermediate level and is receiving grant -in -aid from State of U.P. In this college, there is one post of clerk. The petitioner was appointed as class IV employee in the college on 01.02.1980. The post of clerk fell vacant in the year 1988. The petitioner passed High School Examination in the year 1976, Uttar Madhyama Examination in the year 1986 and Shashtri Examination in the year 1988 from Sampurnanand Sanskrit University, Varanasi. Committee of Management of the college notified the vacancy of the post of clerk for direct recruitment on 01.08.1988. The petitioner filed a representation to Committee of Management on 12.08.1988 for promoting him on the post of clerk. The petitioner made a reminder on 19.08.1988. But in pursuance of the notification, Committee of Management held selection on 24.08.1988 and on the basis of report of Selection Committee appointed Bramha Kumar Saxena (respondent -3) and submitted papers for approval to RIGS. The petitioner on coming to know about the selection of Bramha Kumar Saxena (respondent -3), filed an appeal before RIGS on 05.09.1988. RIGS by letter dated 21.10.1988 disapproved the appointment of Bramha Kumar Saxena (respondent -3) and directed to fill -up the vacancy from promotion. RIGS thereafter, issued letter dated 07.11.1988 approving the appointment of Bramha Kumar Saxena (respondent -3) on the post of clerk. Hence, this writ petition has been filed.;
