JUDGEMENT
-
(1.) WE have heard Sri S.P. Singh for the respondent -appellant. Learned standing counsel appears for State respondents. Sri Vinod Sinha appears for petitioner -respondent No.1.
(2.) LEARNED Single Judge has interfered with the process of election.
(3.) IT appears that one Sri Iqbal Beg filed a Writ Petition No. 66426 of 2012, which was disposed of by order dated 19.12.2012, with observations that the Court is not interfering with the determination of electoral college at this stage, however, right is reserved in favour of petitioners to challenge the elections, after they are over, before the appropriate authority by making such representation as may be permissible under law. The Court further added that if the objections are filed they shall be considered by the authority concerned before proceeding to approve the elections after affording opportunity to the elected office bearers.
As soon as the electoral college was determined, Dr. Shahabuddin - the petitioner -respondent No.1 filed a writ petition in which the learned Single Judge, despite dismissal of the earlier writ petition, has interfered, and has allowed the writ petition on the grounds that objections of the petitioners were not considered by the District Inspector of Schools, who is holding the election, in determining the electoral college.;
