JUDGEMENT

(1.) HEARD Sri Gulab Chandra, learned counsel for the petitioner and learned Standing Counsel for the respondents.
(2.) THIS writ petition has been filed seeking a direction to the respondents to ensure payment of entire arrears of salary w.e.f. 3.8.2007 to 6.10.2009 with 18% interest.

FROM the averments in the writ petition, it appears that services of the petitioner were terminated on 3.8.2007 on the ground that he did not fulfill the requisite medical eligibility of height for the post of Constable. He filed Writ Petition No.39152 of 2007, which was disposed of finally on 4.8.2009 with a direction to the respondents to constitute a Board under the Chief Medical Officer, Gautam Budh Nagar and two other doctors who will measure the height of the petitioner and if the petitioner is found to possess the minimum height, he would be taken back in service. In pursuance of the order of this Court, a Medical Board was constituted. Thereafter on the basis of its report the petitioner was reinstated in service on 7.10.2009. This writ petition claiming the arrears of salary for the period from 3.8.2007 to 6.10.2009 has been filed in 2014. It is clearly barred by laches.
Sri Gulab Chandra submits that the petitioner has been making repeated representation after 2009 but no order has been passed. Repeated representation do not extend the period of limitation and do not condone the delay. Law in this regard has been settled by the Supreme Court in the following cases: -;
