- (1.) THE petitioners have challenged the order dated 15 November 2004, passed by the Central Administrative Tribunal, Allahabad Bench, Allahabad1 in Original Application Nos.1502 of 2012, 1689 of 2012, 1571 of 2012 and 145 of 2013.

ORIGINAL Applications had been before the Tribunal for issuing directions to restrain the respondents of the application from applying the principle of reservation while making promotions to the post of Diesel Shunter in Allahabad Division, North Central Railway. They further prayed for issuing directions to the respondents to make promotions strictly in accordance with the criteria of seniority -cum - suitability.

THE Railway Board issued RBE No. 161 of 2009 dated 3 September 2009 mentioning therein that promotions to the post carrying the Grade Pay below Rs.4,200/ - shall continue to be made as per the existing procedure. The promotions to the posts of Diesel Shunter are made from Assistant Loco Pilot/Diesel and Senior Assistant Loco Pilots/Diesel on the basis of Seniority -cum -Fitness or Seniority -cum -Suitability. The Department published a seniority list on 30 March 2012. Admittedly some of the persons who were juniors to the applicants in the seniority list, were sent for training so as to grant them promotions on the post of Diesel Shunter (against the unreserved posts).;
