JUDGEMENT

- (1.) THE petitioner is a selected candidate for the post of Lecturer in Geography by the Uttar Pradesh Secondary Education Services Selection Board (for short, the "Board"). He has preferred this writ petition against the order dated 13th November, 2013 passed by the Board whereby the place of posting of the petitioner has been changed.
(2.) THE broad essential facts are that the Board issued an advertisement, bearing Advertisement No. 1 and 2 of 2010, inviting applications for the posts of Assistant Teacher and Lecturer respectively in recognised and aided High Schools and Intermediate Colleges of the State. In pursuance of said Advertisement No. 2 of 2010, the petitioner applied for the post of Lecturer in Geography under the Other Backward Classes (O.B.C.) category. It is stated that the petitioner was selected and in the select list he got the marks more than the last selected candidate of the General category. Thus, he was treated as a General candidate. In furtherance thereof, the petitioner's name was recommended for appointment as Lecturer in Geography in Raja Chandrachud Singh Vidyapeeth Inter College, Maharajganj, Raebareli, where the petitioner joined on 20th September, 2012 and he was confirmed on 07th October, 2013.
(3.) FROM the records it transpires that a writ petition, being Writ -A No. 40836 of 2012 (Mehadi Hasan v. State of U.P. and others) was filed by one candidate Sri Mehadi Hasan wherein on 22nd August, 2013 this Court issued a direction to the Board to reconsider the matter of placement. In compliance thereof, the Board has issued an amended notification dated 13th November, 2013, whereby the petitioner's placement has been changed from Raja Chandrachud Singh Vidyapeeth Inter College, Maharajganj, Raebareli to Janta Inter College, Parsauni, Etah. Aggrieved by the said order, the petitioner has preferred this writ petition.;
