JUDGEMENT

Krishna Murari, J. - (1.) Heard Sri Shrinath Dwivedi, learned Counsel for the petitioner, learned Standing Counsel for respondent Nos. 1 and 2 and Sri A.P. Singh holding brief of Sri Hemendra Pratap Singh for respondent No. 3.
(2.) With the consent of the learned Counsel appearing for the respective parties, the writ petition is disposed of finally at the stage of admission.

Against proposed allotment, the petitioner filed an objection on the ground that out of total area of 0.936 hectare of plot No. 237 which is his original holding he has been allotted only an area of 0.140 hectare and entire area of plot No. 337 may be allotted in his chak. The Consolidation Officer vide order dated 5.11.1999 dismissed the said objection. The Settlement Officer, Consolidation vide order dated 10.3.2004 partly allowed the appeal filed by the petitioner and allotted an area of 0.466 hectare of the said plot in his chak. Subsequently, after a lapse of three years and nine months the respondent No. 3 filed a revision challenging the order of the Settlement Officer, Consolidation on the ground that the appellate order was passed without hearing his father who died during the pendency of the appeal and he having inherited the chak of his father is facing difficulty in cultivating two chaks as such both the chaks should be made parallel to each other. The Deputy Director of Consolidation vide order dated 25.9.2004 allowed the revision. Feeling aggrieved, the petitioner has fled the present writ petition.;
