JUDGEMENT

(1.) In all the above Habeas Corpus writ petitions, the impugned detention orders in respect of all the petitioners have been passed on the basis of the one and same incident, hence, they are taken up together and are disposed of by a common order.
(2.) In all the four Habeas Corpus Writ Petitions, the validity of the detention orders dated 21.12.2003 passed by the District Magistrate, Sidharth Nagar under section 3(2) of the National Security Act, 1980 has been challenged.
(3.) According to the FIR, the petitioners were found involved in cutting of electricity wire in an organised way. The petitioners caused disruption of electric supply of the district as a result of which services of essential supplies were disturbed. In-spite of the fact that the petitioners were challenged in various criminal cases, they did not abstain themselves from committing such crimes. In the night of 14/15.11.2003, the petitioners were found ACC (2)-58 cutting High Tension Supply Wire and disrupted the electric supply in the southwest area of the District. They were caught on the spot and were detained in District Jail, Basti. in connection with that case crime. The District Magistrate was of the opinion that the petitioners shall again involve themselves in committing such crimes, if they are released on bail. In these circumstances, the District Magistrate, Sidharth Nagar was satisfied that as the petitioners were involved in various cases of disrupting the essential supplies in the district, it was necessary to pass detention orders against the petitioners.;
