JUDGEMENT

(1.) PETITIONER , who claims to be a Senior Sub -Inspector of Police, has filed this writ petition, challenging the order of his transfer dated 5.7.1993, whereby he has been transferred from Civil Police to Government Railway Police (hereinafter referred to as the GRP). Only submission made by the learned counsel for the petitioner in support of the writ petition is that GRP is entirely different from Civil Police and is a separate cadre having its own seniority list and, as such, it is not open to respondents to transfer the petitioner from Civil Police to GRP, inasmuch as it amounts to transfer from one cadre to another, which is not permissible under law. It is not possible to agree with the learned counsel. According to Regulation 396 of U.P. Police Regulations, the Police Force of this State consists of Provincial Police (Civil, Armed and Mounted), Government Railway Police and village Chaukidar. Regulation 525 of the Regulations permits the transfer of the police personnel from one branch to another. Power to transfer under the Regulation vests in the Director -General of Police, which has been delegated by him vide order dated 21/29 -3 -1990 to Deputy Inspector -General (Personnel) Police Head Quarter, UP. Allahabad. In Moonga Lal v. The D.I.G. (Karmik), U.P. Police Head Quarter, Allahabad and others, (Writ Petition No. 19389 of 1993), decided on 12 -8 -1993, this court has upheld the above order of delegation of power by Director -General of Police to Deputy Inspector -General (Personnel), Police Head Quarter, U.P. Allahabad and has accordingly upheld the transfer of police personnel from one branch to another by Police Head Quarter. In paragraphs 7, 8, 13 and 14 of the counter -affidavit, filed on behalf of the respondents, it has been stated that GRP is not a separate cadre as alleged by the petitioner; but on the other hand it is an integral part of U.P. Police and combined inter seniority list of Senior Sub -Inspectors posted in Civil Police as well as GRP is maintained at the Police Head Quarter, Allahabad. The allegations made by the petitioner to the contrary in his writ petition have been denied in the counter -affidavit.
(2.) WRIT Petition lacks merit and is accordingly dismissed.;
