JUDGEMENT

M. Katju, J. - (1.) This writ petition has been filed against the impugned order dated 13-5-1992. (Annexure-5 to the writ petition) by which the District Inspector of Schools, Azamgarh, has attested the signature of Mohd. Imran respondent No. 3 as the Manager of Management Inter College, Mubarakpur, Azamgarh. It has been alleged in the petition that election was held for the Committee of Management of the Institution on 6-6-1990 and the petitioners Committee of Management was elected and petitioner No. 2 was elected as Manager. It is further alleged that the signature of petitioner No. 2 was attested by the District Inspector of Schools vide Annexure-3 to the writ petition. It is however, alleged that subsequently a representation was made by one Absan Ahmad alleging himself to be the President of the Committee of Management and on this application the District Inspection of Schools appointed one Sheo Govind Singh as the observer to hold the election on 13-10-1991.
(2.) By the impugned order dated 13-5-1992 the District Inspector of Schools has attested the signature of Mohd. Iman who claimed to have been elected in the said election on 13-10-1991 as Manager of the Institution. The petitioner has alleged that opportunity of hearing was not given to him before passing the impugned order dated 13-5-1992.
(3.) A counter-affidavit has been filed by Mohd. Imran as well as by the District Inspector of Schools. In Paragraph-4 of the counter affidavit of District Inspector of Schools, it has been alleged that the allegation in Paragraph-3 of the petition are not correct, it is further alleged that no papers regarding the alleged election of 5-6-1987 was received in the Office of the District Inspector of Schools.;
