- (1.) By means of present writ petition, Shri Ram Gopal Sharma a Sanskrit Lecturer in D.A.V. Inter College Agra (Subsequently the District of Firozabad was carved out and the College now falls in district Firozabad), has challenged the order dated 22.4.1983 of the Regional Deputy Director of Education, 1st Regional, Allahabad who has been impleaded as respondent No. 1.
(2.) By the said order, respondent No. 1 has issued a direction by which Laiq Singh, respondent No. 4 was promoted as Sanskrit Lecturer in place of the petitioner.

The necessary facts for resolving the controversy involved in the present writ petition are as follows : The post of Sanskrit Lecturer fell vacant and an advertisement for filling up of that post was issued on 20.9.1980 and 2.10.1980 in two different newspapers. In the advertisement, it was specifically mentioned that the post was reserved for the members of Scheduled Caste/Schcduled Tribe. But, if no candidate from the said category was available, the post was to be filled from amongst the candidate of Background category.;
