JUDGEMENT
Vijai Bahuguna, J. -
(1.) This bunch of writ petitions were heard together and with the consent of counsel for parties the same are being disposed of by a common judgment.
(2.) The petitioners, in these writ petitions, were appointed as Registration Clerks on daily wages on various dates. By interim orders passed on different dates the petitioners were permitted to continue in service till substantive appointment by selection were made. On the 24th of March, 1991 an advertisement notice was issued by the Inspector General of Registration, U P. Allahabad Inviting applications for appointment on the posts of Registration Clerks. The petitioners contend that as they have been working with artificial breaks in service from the year 1983 awards they should be absorbed and their services should not be terminated. Under the U. P. Registration Department (District Establishment) Ministerial Service Rules, 1973 (hereinafter referred to as the 1973 Rules) as amended in 1991, the posts of the Registration Clerks have to be filled in by regularisation through examination.
(3.) In the counter-affidavits it is stated that the daily wage Registration Clerks were allowed to be engaged with the approval of the concerned Collectors to meet the exigencies of work as there were accumulated arrears. It has been further stated that the daily wagers have worked only for short periods from 1988 onwards and have not put in continuous service and their services were dispensed as there was no work in the Department. It is also stated that the petitioners were not appointed against regular vacancies and were appointed on dally wages to meet the exigencies of work.;
