JUDGEMENT

(1.) Petitioner was appointed as Part Time Tube Well Operator on 29-6-1984 for a period of three years. After the expiry of three years, the petitioner has been permitted to continue to work as Part Time Tube well Operator and has been paid his salary regularly, although there is no specific order extending the term of his appointment. On 3-12-1988 the Superintending Engineer inspected the tube-well of which the petitioner was a part Time Tube Well Operator, and found him absent and from the enquiry made from the villagers, it was discovered that the petitioner does not live in the village in which the tube-well is situated. The Superintending Engineer accordingly passed a speaking order on the same day, directing for termination of his service for the reasons given therein. The executive Engineer terminated the service of the petitioner in accordance with the above order of the Superintending Engineers and it was also mentioned therein that he was found absent at the time of inspection of the tube-well by the Superintending Engineer. Against the order of termination of service, petitioner filed a representation, but the same not having been decided he filed a writ petition before this Court, which was disposed of on 3-4-1984 with a direction to the respondents to decide his representation. By a non-speaking order dated 4-5-1989 the petitioners representation has been rejected. It is against the above orders that this writ petition has been filed by him.
(2.) The respondents have filed counter-affidavit and the petitioner has filed a rejoinder affidavit in reply thereto. 1 have heard the learned counsel for the petitioner and the learned standing counsel.

From the perusal of the order dated 3-12-1988, passed by the Superintending Engineer and the order dated 7-12-1988, passed by the Executive Engineer, terminating the service of the petitioner, it is apparent that these orders are not the orders of termination simpliciter. They are speaking orders by which stigma has been cast against the petitioner.;
