JUDGEMENT
K.N.Mishra, J. -
(1.) Heard counsel for the petitioner and persued the impugned order dated 22nd August 1983 passed by the Board of Revenue by which the sale held on 7.2.81 of the agricultural plot of opposite party No. 4, for the realisation of the dues of the Punjab National Bank has been set aside on the ground that the entire proceedings for conducting sale were not made in accordance with the prescribed procedure under Section 1l-A of the U.P. Agricultural Credit Act, 1973. The learned counsel for the petitioner urged that since in this case no objection under rules 285-H and 283-I of U.P. Act No. I of 1951 were filed by the objector and as such the sale could not be set aside by the Board of Revenue and in exercise of the revisional powers under Section 219 of the U.P. land Revenue Act, I am unable to accept this submission. The entire proceedings for conducting sale of agricultural land for the realisation of the Bank dues were invalid being not made in accordance with the provisions of Section 11-A of the said Act, and as such I find that the Board of Revenue could set aside the auction sale which was conducted illegally. Even apart from that since in the present case the sale of the agricultural land was illegally made as aforesaid, I find that no case is made out for inference by this Court in exercise of powers under Article 226 of the Constitution. The writ petition is devoid of merit and it is accordingly dismissed in limine.
