The petitioner applied for the post of Assistant Professor (Livestock Production and Management) in pursuance of the advertisement no.1 of 2013 issued by Sardar Vallabhbhai Patel University of Agriculture & Technology, Meerut under SC category. The petitioner claimed himself to be handicapped also. The petitioner has also been called for the interview. However, the petitioner has not been selected.

Sri P.K.Ganguly, learned counsel appearing on behalf of the respondents submitted that the selection process has been completed and the selectee has joined, on which learned counsel for the petitioner submitted that one post was reserved for each SC and handicapped category and the petitioner was the only candidate, therefore, the said post is still vacant.

The contention of learned counsel for the respondent is that he has not been selected because the instructions mentioned in the advertisement under clause 18 of "general instructions for candidates for appointment by selection for Teaching, which provides that third division at any stage of academic carrier is not eligible in Teaching/Research/Extension (TRE) and since the petitioner passed High School in third division, therefore, he was not found eligible and has not been selected.;
